Negligence Claims and Construction Projects (Breakfast Session) – Burnaby
January 17, 2020 @ 7:30 am - 10:30 am
The conduct of a party on a construction project may constitute not only breach of contract but also negligence. In particular, parties that do not have a contractual relationship may allege negligence against one another. Negligence claims vary in scope including injury on site, mismanagement of the project, or a major deficiency in the project arising before or after completion. It is important to understand what obligations arise between parties on a construction project that could give rise to claims in negligence and how to guard against and respond to a claim in negligence.
In this presentation we will review the following aspect of a negligence claim using examples from real cases.
Topics covered:
- What is a negligence claim?
- Concurrent claims in contract and negligence
- Defences to a negligence claim?
- Is the negligence claim covered by insurance?
