SUMMARY:Construction Law
DESCRIPTION:Participants will develop an understanding of contract law as it relates to construction and the various CCDC/CCA and other contracts used within the industry. Participants will also learn how the BC Builders Lien Act works and the other legal means to resolve construction disputes and avoid litigation. At the end of the course participants will be able to:\n\nUnderstand the basics of contract law –intention\, offer\, acceptance\, consideration\, capacity and legality\nBe familiar with various CCDC/CCA contracts -how and why they are used\nBe familiar with various legal terms used in contracts\nUnderstand the contract responsibilities of various parties\nUnderstand the bidding process and contractual obligations\nDefine back charges and how to avoid them\nAvoid construction disputes and claims from the site level\nWrite RFIs and Change Orders\nUnderstand the dispute resolution process – negotiation\, mediation\, arbitration\, and litigation\nUse the Builder’s Lien Act to obtain security\nUse the small claims process to collect debts\nUnderstand environmental law and how it impacts projects\nUnderstand safety law and it impacts construction companies\nUnderstand how specifications and drawings fit within the contractual hierarchy\nUnderstand the contractual relationship between contractor and sub-contractor\nCompile and submit proper extras and claims\n\nTopics to be covered:\n\nThe basic concepts of contract law\nCCA\, CCDC and other contracts\nLegal terms used in contracts\nBidding process and contractual obligations\nSpecifications\, drawings and the contractual hierarchy\nContractual relationships between contractor and sub-contractor\nCompiling and submitting proper extras and claims\nDefining back charges and how to avoid them\nAvoiding construction disputes and claims from the site level\nWriting RFIs and Change Orders\nThe dispute resolution process\nThe Builder’s Lien Act\nThe Small Claims process\nEnvironmental law\nSafety legislation and regulations\n\nTwo days (16 hours) of lessons with instructors plus an online portion involving research\, reading and answering questions (7-8 hours) that will be marked by the instructors. \n  \nInstructors \n  \nTim Williams MBA\, B.Econ.\, CPA\, GSC\, is the President of BGC Partners Inc. SUMMARY:Proposal Development Workshop
DESCRIPTION:This 1-day course provides an overview of the key factors that separate proposals that win from those that do not. This course addresses proposals in response to a formal Request for Proposals (RFP)\, Request for Qualifications (RFQ)\, Request for Information (RFI) from vendors\, proposals prepared to address a potential business opportunity as well as less formal estimates and quotes. \nThis course is suitable for anyone involved in the proposal development process\, including individuals that make decisions on whether or not to respond to a proposal opportunity. \nDuring the course participants will learn the factors that lead to a successful proposal\, some of which include: \n\nEnsuring the proposal is aligned with your organization’s strategy\nUnderstanding the competitiveness of your organization before spending the time and effort on a proposal\nEstablishing a clear process for managing the creation of a proposal including who to involve and when\nTailoring proposals to address client needs in a logical way that demonstrates your organization’s credibility\nPresenting and organizing the proposal material in a clear\, persuasive manner\nUnderstanding the potential risk to your organization given the nature of the work and the potential customer\n\nParticipants will be exposed to a number of proposal types and examples\, as well as tools and templates for managing the proposal creation process. \nInstructor: Janet Bonaguro\, Principal of ThinkSpace Performance\, has worked with over 100 organizations locally\, nationally and internationally.
