DESCRIPTION:Participants will develop skills and knowledge of how to manage a construction project. DESCRIPTION:Participants will develop an understanding of contract law as it relates to construction and the various CCDC/CCA and other contracts used within the industry. Participants will also learn how the BC Builders Lien Act works and the other legal means to resolve construction disputes and avoid litigation. At the end of the course participants will be able to:\n\nUnderstand the basics of contract law –intention\, offer\, acceptance\, consideration\, capacity and legality\nBe familiar with various CCDC/CCA contracts -how and why they are used\nBe familiar with various legal terms used in contracts\nUnderstand the contract responsibilities of various parties\nUnderstand the bidding process and contractual obligations\nDefine back charges and how to avoid them\nAvoid construction disputes and claims from the site level\nWrite RFIs and Change Orders\nUnderstand the dispute resolution process – negotiation\, mediation\, arbitration\, and litigation\nUse the Builder’s Lien Act to obtain security\nUse the small claims process to collect debts\nUnderstand environmental law and how it impacts projects\nUnderstand safety law and it impacts construction companies\nUnderstand how specifications and drawings fit within the contractual hierarchy\nUnderstand the contractual relationship between contractor and sub-contractor\nCompile and submit proper extras and claims\n\nTopics to be covered:\n\nThe basic concepts of contract law\nCCA\, CCDC and other contracts\nLegal terms used in contracts\nBidding process and contractual obligations\nSpecifications\, drawings and the contractual hierarchy\nContractual relationships between contractor and sub-contractor\nCompiling and submitting proper extras and claims\nDefining back charges and how to avoid them\nAvoiding construction disputes and claims from the site level\nWriting RFIs and Change Orders\nThe dispute resolution process\nThe Builder’s Lien Act\nThe Small Claims process\nEnvironmental law\nSafety legislation and regulations\n\nTwo days (16 hours) of lessons with instructors plus an online portion involving research\, reading and answering questions (7-8 hours) that will be marked by the instructors. \nInstructors \nTim Williams MBA\, B.Econ.\, CPA\, GSC\, is the President of BGC Partners Inc. SUMMARY:An Overview of Tendering Law (Breakfast Session)
DESCRIPTION:As a method of procurement\, tendering can be fraught with risks. Errors in accepting or evaluating bids can result in legal liability on the part of the tendering authority.  Errors in the bid submitted in response to an Invitation to Tender can result in legal liability on the part of the bidder.  The law of tenders is complicated and constantly evolving as the courts and the construction industry adapt to new technology and evolving project delivery methods. \nCourse Outline: \n\nIntroduction to the law of tendering including an overview of:\n\n\nThe difference between tenders and RFPs and other procurement methods\nThe bidder’s obligations to the tendering authority\nThe tendering authority’s obligations to the bidder\n\n\nTendering case law update and discussion of recent decisions\nPractical tips and advice on key aspects of tendering\n\nPresenter: An Associate Counsel with SHK\, Marc MacEwing has practiced extensively as a construction lawyer in all aspects of the practice for over 30 years. He has particular expertise as a builders lien lawyer\, as well as in tendering disputes and preparing and analyzing contract documents.
