SUMMARY:An Overview of CCDC Contract Documents (Breakfast Session) - Burnaby
DESCRIPTION:The standard form Canadian Construction Documents Committee (CCDC) construction contracts are used across Canada in connection with general contract\, construction management and trade contract arrangements. This course will provide an overview of the most commonly used CCDC documents\, and of the standard CCA 1 subcontract\, with specific focus on the concepts and procedures of the provisions relating to the following significant concerns\, among others: \n1.            The definition of the Contract Documents; \n2.            The role of the Consultant; \n3.            Payment; \n4.            Extra work; \n5.            Delays; \n6.            Deficiencies; \n7.            Dispute resolution; and \n8.            Default and termination. \nRelated issues such as the effect of supplementary conditions and the interaction of the contracts with the operation of the Builders Lien Act will also be addressed. \nWho should attend? \nOwners\, contractors\, construction managers\, subcontractors and design professionals. \nPresenter: An Associate Counsel with SHK Law Corp.\, Marc MacEwing has practiced extensively as a construction lawyer in all aspects of the practice for over 30 years. He has particular expertise as a builders lien lawyer\, as well as in tendering disputes and preparing and analyzing contract documents. DESCRIPTION:Participants will develop an understanding of contract law as it relates to construction and the various CCDC/CCA and other contracts used within the industry. Participants will also learn the other legal means to resolve construction disputes and avoid litigation. At the end of the course participants will be able to:\n\nUnderstand the basics of contract law –intention\, offer\, acceptance\, consideration\, capacity and legality\nBe familiar with various CCDC/CCA contracts -how and why they are used\nBe familiar with various legal terms used in contracts\nUnderstand the contract responsibilities of various parties\nUnderstand the bidding process and contractual obligations\nDefine back charges and how to avoid them\nAvoid construction disputes and claims from the site level\nWrite RFIs and Change Orders\nUnderstand the dispute resolution process – negotiation\, mediation\, arbitration\, and litigation\nUse the Builder’s Lien Act to obtain security\nUse the small claims process to collect debts\nUnderstand environmental law and how it impacts projects\nUnderstand safety law and it impacts construction companies\nUnderstand how specifications and drawings fit within the contractual hierarchy\nUnderstand the contractual relationship between contractor and sub-contractor\nCompile and submit proper extras and claims\n\nTopics to be covered:\n\nThe basic concepts of contract law\nCCA\, CCDC and other contracts\nLegal terms used in contracts\nBidding process and contractual obligations\nSpecifications\, drawings and the contractual hierarchy\nContractual relationships between contractor and sub-contractor\nCompiling and submitting proper extras and claims\nDefining back charges and how to avoid them\nAvoiding construction disputes and claims from the site level\nWriting RFIs and Change Orders\nThe dispute resolution process\nThe Builder’s Lien Act\nThe Small Claims process\nEnvironmental law\nSafety legislation and regulations\n\n\n\n\n\n\n\nTwo days (16 hours) of lessons with instructors plus an online portion involving research\, reading and answering questions (7-8 hours) that will be marked by the instructors. \n Register Now!
